These terms govern your use of the Pocket Pinball app and the pocketpinball.com website, both operated by Retro Eki. By using either, you accept these terms.

What Pocket Pinball is

Pocket Pinball is an Android application that plays Visual Pinball X table files on phones and tablets. It is a player. It does not include any tables, ROM files or companion media.

We are not affiliated with, endorsed by, or connected to the Visual Pinball X project or its developers. Visual Pinball X is an independent open-source project, and the tables you play are created by the wider virtual pinball community.

Content you supply

You supply your own table files, ROM files and companion media. You are responsible for making sure you have the legal right to use every file you add to the app, in your own country.

We do not provide ROM files, and we do not link to them. Please do not ask us to. ROM files are usually still covered by copyright, and whether you may lawfully hold one depends on your circumstances and where you live. That judgement is yours to make.

Tables are created by community authors who retain their own rights in them. Respect their licences, credits and wishes.

Acceptable use

Do not use Pocket Pinball to break the law, to distribute files you have no right to distribute, or to interfere with the service or other users. Do not attempt to gain unauthorised access to our systems.

Leaderboards

The leaderboard is a shared, public feature and we want it to mean something. We may remove scores, reset entries or suspend accounts where we believe a score was not achieved through genuine play, or where a display name is offensive or impersonates someone.

Choose initials and a display name you are happy to have shown publicly. Do not use personal information.

Availability

We provide the app and site as they are, and we may change, suspend or discontinue features. We do not promise that every table will run correctly. Tables are made by third parties and vary widely in how they behave, and phone hardware varies too.

The store

Purchases from the merch store are subject to the delivery and returns information shown at checkout.

Our rights

The Pocket Pinball app, its name, logo and the content of this website belong to us or our licensors. You may not copy, redistribute or reverse-engineer the app except where the law says you may.

The app includes open-source components, which remain under their own licences.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, for loss of data, or for any loss arising from files you add to the app. If you are a consumer, you keep all your statutory rights.

Ending your use

You can stop using the app at any time by uninstalling it. We may suspend or end your access if you break these terms.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or EU, you keep the protection of your local mandatory laws.
